1. About These Terms

These Terms & Conditions apply to classes, workshops, courses, programs, coaching, audition-related services, events, and other services sold or provided by Open Frame Studios (“OFS”, “we”, “us”, or “our”), unless a specific written agreement for a service states otherwise.

By completing a booking or accepting an offer, you enter into a contract with Open Frame Studios. Mandatory rights that apply to consumers under Dutch or other applicable consumer law are not excluded or limited by these Terms.

2. Admissions, Participation and Conduct

Some classes or programs have prerequisites, an application process, an interview, or instructor approval. Where approval is required, a place is not confirmed until OFS has accepted the participant and the required payment or deposit has been received.

Participants under 18 may attend only where OFS has agreed to the booking and a parent or legal guardian has provided any consent reasonably required for the activity.

OFS may remove a participant whose conduct is materially disruptive, discriminatory, threatening, unsafe, or prevents the class from being delivered properly. Any refund or remaining payment obligation will be determined reasonably in light of the circumstances and mandatory law.

3. Bookings, Contract Formation, Prices and Payment

Bookings are made through the OFS website or another method expressly offered by OFS. A booking is confirmed when OFS sends a booking or enrollment confirmation after receiving the payment, deposit, or other amount required for that booking.

Consumer prices displayed on the website are in euros and include VAT where VAT applies. Any mandatory additional charge will be disclosed before the customer places the order.

Online payments are processed by Mollie or another payment provider identified during checkout. OFS does not receive or store full payment-card details processed by the payment provider.

Where a payment plan is agreed, the due dates and amounts will be disclosed before the plan is accepted. A payment plan does not remove any statutory withdrawal, termination, or cancellation right. If a booking is later cancelled, the amount lawfully due is determined by applicable law, Section 5, and any service-specific terms disclosed before booking; the existence of a payment plan does not by itself make every remaining instalment automatically payable.

If OFS offers an automatically renewing or ongoing consumer subscription, the service-specific booking information will state the initial term, renewal arrangement, billing frequency, price, and how to cancel. Where the law requires online cancellation because the subscription was concluded online, OFS will provide an online cancellation method.

Immediately before a paid online booking is completed, the customer will be shown the main booking information and the total price. The final payment action will clearly indicate that completing the booking creates a payment obligation.

4. Statutory Right of Withdrawal for Online Consumer Bookings

Where Dutch or other applicable consumer law gives you a statutory right of withdrawal for an online booking, you may withdraw from the contract within the applicable 14-day withdrawal period without giving a reason. For a service contract, the withdrawal period generally runs for 14 days after the contract is concluded.

You may exercise the statutory right of withdrawal by using our online withdrawal function at https://openframestudios.nl/withdrawal/, by sending us an unambiguous statement at billing@openframestudios.nl, or by using the Model Withdrawal Form available on the withdrawal page. The online function is an additional option and does not prevent you from using another legally valid method.

If you use the online withdrawal function, we will send an electronic acknowledgment without undue delay showing the content of your withdrawal statement and the date and time it was submitted.

If you expressly request that a paid service begin during the 14-day withdrawal period, and you later exercise a valid right of withdrawal after performance has begun, you may be required to pay a proportionate amount for the service supplied up to the time of withdrawal. We will request the legally required express agreement before beginning early performance where that is relevant.

For a paid service that is fully performed during the withdrawal period, the statutory withdrawal right ends after full performance only where the legal requirements for your prior express consent and acknowledgment have been met.

Certain contracts are excluded from the statutory withdrawal right by law, including some services connected with leisure activities where a specific date or period of performance has been agreed. OFS will rely on a statutory exception only where it applies to the particular booking and the absence of a withdrawal right is disclosed before the booking is completed.

Where you validly withdraw, OFS will refund amounts that must be refunded under applicable law without undue delay and no later than 14 days after OFS receives the withdrawal statement. Unless another method is expressly agreed, the refund will be made using the same payment method used for the original transaction and without a refund fee.

The statutory right of withdrawal is separate from the cancellation and rescheduling rules in Section 5.

5. Cancellations, Rescheduling and Refunds Outside the Statutory Withdrawal Right

The rules in this section apply after any applicable statutory withdrawal right has expired or where no statutory withdrawal right applies. They do not reduce any mandatory consumer right.

Single classes and individual sessions: if you cancel at least 48 hours before the scheduled start time, you may request one reschedule, subject to availability. If you cancel less than 48 hours before the start time or do not attend, OFS may charge a cancellation fee up to the price of the reserved session where that amount is reasonable in the circumstances, taking into account the reserved place, costs already incurred, costs OFS can avoid, and whether the place can reasonably be filled. Mandatory law takes precedence.

Multi-session courses and programs: you may ask to cancel even after any statutory withdrawal period has ended. OFS may charge reasonable cancellation costs where permitted by law. Those costs may reflect work already performed, unavoidable costs already incurred, and reserved capacity that cannot reasonably be re-filled, while taking account of costs OFS saves because the remaining service will not be provided. Any stated deposit, percentage, or cancellation schedule applies only to the extent it is transparent, was disclosed before booking, and results in a reasonable charge in the circumstances.

If OFS has already received more than the amount reasonably due after a cancellation, the excess will be refunded. If a payment plan is in place, only amounts that are lawfully due after applying the cancellation rules remain payable; the payment plan does not automatically make the full unpaid balance due.

Bookings and places may not be transferred to another person without OFS’s prior written approval.

6. Changes or Cancellation by Open Frame Studios

OFS may make reasonable changes to an instructor, room, format, or schedule where necessary. We will give participants as much notice as reasonably possible.

If OFS makes a material change that substantially affects the booked service and you do not accept a reasonable alternative, you may cancel the affected booking and receive a refund for the part of the service that will not be supplied.

If OFS cancels a class, course, program, or other paid service and does not provide an acceptable alternative, OFS will refund the amount paid for the cancelled service or the unused portion, as applicable. Except where mandatory law provides otherwise, OFS is not responsible for separate costs such as travel or accommodation.

7. Attendance

Acting training may be cumulative and may depend on partner and ensemble work. Participants are expected to attend the sessions included in their booking and to communicate anticipated absences where reasonably possible.

Missed sessions are not automatically refundable, transferable, or eligible for a make-up session. Any make-up option depends on the structure of the program, availability, and any service-specific terms disclosed before booking.

8. Health, Accessibility and Safety

OFS aims to provide a safe and respectful training environment. Participants must follow reasonable safety instructions and must not knowingly attend or participate in a way that creates a material and avoidable safety risk to themselves or others.

If you need an accessibility adjustment or believe there is information OFS reasonably needs in order to provide the service safely, please contact us. Share only the information that is necessary for that purpose. Health information is sensitive personal data and will be handled in accordance with our Privacy Policy.

Participation in acting training may involve physical movement, emotional material, close partner work, or other exercises described by the instructor. You may raise a safety concern or ask for a reasonable alternative where appropriate. OFS may stop an exercise or participation where necessary to address an immediate safety concern.

9. Photography, Video and Recordings

Some classes may use photography or recording as part of the teaching method, for example on-camera training or playback. Where recording is part of the service, this will be explained in the class or service description or before the recording takes place.

OFS will not rely on acceptance of these Terms alone as consent to use an identifiable participant’s image, voice, or recording for advertising, social media, testimonials, or other promotional purposes. Promotional use will be based on separate consent or another valid legal basis. Refusing promotional consent will not affect eligibility to participate in a class.

Where promotional use is based on consent, that consent may be withdrawn for future use. Withdrawal does not make processing that occurred before withdrawal unlawful and may not make it possible to recall material already lawfully printed or distributed.

10. Intellectual Property and Class Materials

OFS retains the intellectual property rights it owns in its original course materials, exercises, handouts, recordings, branding, and other content. Participants may use materials supplied for their personal training unless OFS states otherwise, but may not reproduce, publish, sell, record, or distribute OFS materials or another participant’s work without permission.

Third-party scripts, scenes, texts, or other materials remain subject to the rights of their respective owners.

11. Privacy and Personal Data

OFS processes personal data in accordance with applicable data-protection law, including the GDPR. Our Privacy Policy explains the categories of information we use, purposes and legal bases, recipients, retention, international transfers, and your rights. Our Cookie Policy explains cookies and similar technologies used on the website.

12. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer rights and liability where exclusion is prohibited by law.

To the extent permitted by law, OFS is not responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was concluded, or for loss caused by a participant’s failure to follow reasonable safety instructions or by circumstances outside OFS’s reasonable control.

Participants remain responsible for their personal belongings and for arranging any personal insurance they consider appropriate.

13. Complaints

If you have a complaint about a booking or service, contact info@openframestudios.nl with enough information for us to understand the issue. We aim to acknowledge complaints within 5 business days and provide a substantive response within 30 days where reasonably possible.

If a complaint concerns the processing of personal data, you also have the right to lodge a complaint with the Autoriteit Persoonsgegevens. Nothing in this section limits any right to use a competent court or another dispute-resolution route that is available under mandatory law.

If OFS becomes affiliated with a specific consumer dispute-resolution body, the applicable details will be provided on the website and in these Terms.

14. Force Majeure and Circumstances Outside Reasonable Control

OFS is not responsible for delay or failure caused by circumstances outside its reasonable control, such as serious illness, emergency closure, government measures, utility or transport disruption, or loss of venue access. OFS will take reasonable steps to reduce the effect on participants and, where appropriate, offer a reschedule, alternative, credit, or refund consistent with mandatory law and the nature of the affected service.

15. Changes to These Terms

OFS may update these Terms for future bookings. The version in force when your contract is concluded will normally apply to that booking. A later change will not materially reduce rights under an existing booking unless the change is required by law or you expressly agree to it.

16. Governing Law and Jurisdiction

These Terms are governed by Dutch law. If you are a consumer who is entitled to mandatory consumer protections of another country, this choice of law does not deprive you of those mandatory protections.

Disputes may be brought before the courts that have jurisdiction under applicable law. Nothing in these Terms removes a consumer’s right to use a court that mandatory consumer-jurisdiction rules make available.
